PixVault Terms of Use

These Terms of Use set out the conditions for use of the iPhone, iPad, and Mac app "PixVault" (the "App") provided by Foshan Gaoming Huiyang Network Technology Studio (the "Operator"). By using the App, users are deemed to have agreed to these Terms.

Article 1. Scope

  1. These Terms apply to all relationships between the Operator and users concerning use of the App.
  2. Explanations, notices, guides, and similar information posted in the App or on related pages form part of these Terms.

Article 2. App Content

  1. The App lets users convert image formats, compress images, resize images by longest edge, and remove metadata such as EXIF data, GPS location, camera model, lens model, and timestamps by creating newly encoded output files without copying source metadata. All processing runs locally on the user's device.
  2. The App currently provides format conversion (HEIC, JPEG, PNG, WebP, TIFF), quality-based and target-size compression, longest-edge resizing, metadata removal, a Shortcuts integration with three App Intents, an iPhone and iPad Share Extension, and a Finder Service on Mac.
  3. Specific features, names, screens, designs, and scope of the App may be added, changed, or removed at the Operator's discretion.

Article 3. Fees and Purchases

  1. The App provides basic features free of charge. The free tier processes up to three images per batch.
  2. The App offers a one-time non-consumable in-app purchase that removes the per-batch image limit. This is a single purchase and is not an auto-renewable subscription.
  3. The purchase name, included features, price, and other conditions follow the purchase screen in the App and the App Store listing.
  4. Fees are charged to the user's Apple Account when the purchase is confirmed.
  5. Users can restore the purchase within the App when using the same Apple Account.
  6. Paid fees are generally non-refundable except as required by law or Apple's rules. Refund procedures follow Apple's rules.

Article 4. User Environment

  1. Users are responsible, at their own cost, for preparing the iPhone, iPad, or Mac, Apple Account, and other conditions necessary to use the App.
  2. Output image files created by the App are stored in the device's temporary directory or a user-selected folder. The Operator does not guarantee long-term storage of these files.
  3. If a user is a minor, the user must obtain consent from a legal representative or other necessary person to the extent required for use of the App.

Article 5. Disclaimer for Metadata Removal

  1. The App removes metadata by re-encoding images without copying source metadata, using Apple's ImageIO framework. While this method is effective, the Operator does not guarantee that all metadata is removed in every circumstance or for every image format.
  2. Users are responsible for verifying output files before sharing or uploading them, especially when sensitive location or device information is involved.
  3. The Operator is not liable for any damages resulting from metadata that remains in output files or from the user's reliance on the App's removal results without independent verification.

Article 6. User Data

  1. The App processes images locally on the user's device. The Operator does not collect, transmit, or store user images or personal data.
  2. Users are responsible for the images they process with the App and warrant that they have lawful rights to process those images.

Article 7. Intellectual Property

  1. Copyrights, trademarks, and all other intellectual property rights related to the App belong to the Operator or rightful third-party owners.
  2. Users must not copy, modify, adapt, redistribute, publicly transmit, sell, or perform similar acts regarding all or part of the App except where permitted by law.

Article 8. Prohibited Conduct

  1. Acts that violate laws or public order and morals
  2. Criminal acts or related acts
  3. Acts that infringe intellectual property rights, privacy rights, reputation, or other rights or interests of the Operator or third parties
  4. Acts that interfere with or may interfere with App operation
  5. Unauthorized access to the App or attempts to do so
  6. Reverse engineering, decompiling, disassembling, or otherwise attempting to analyze the App
  7. Using the App for fraudulent or inappropriate purposes
  8. Any other act the Operator considers inappropriate

Article 9. Changes, Suspension, and Termination

  1. The Operator may change all or part of the App without prior notice to users.
  2. The Operator may suspend or stop all or part of the App for maintenance, failure response, natural disaster, legal compliance, or other unavoidable reasons.
  3. The Operator may end provision of the App by announcing it through an appropriate method.

Article 10. Disclaimer

  1. The Operator does not guarantee that the App fits a user's specific purpose, has expected functionality, accuracy, usefulness, continuity, completeness, or safety, or is free from defects.
  2. Except in cases of intentional misconduct or gross negligence by the Operator, the Operator is not liable for disadvantages caused by user device environments, OS versions, Apple specification changes, App Store specification changes, or other circumstances outside the Operator's control.
  3. Users use the App at their own judgment and responsibility.
  4. If all or part of this article is invalid under mandatory laws such as consumer contract laws, the Operator's liability is limited to the extent permitted by those laws.

Article 11. Damages

Even if the Operator is liable for damages to a user, except in cases of intentional misconduct or gross negligence by the Operator, liability is limited to ordinary and direct damages actually incurred by the user.

Article 12. Personal Information

The Operator handles user information in accordance with the separately established Privacy Policy.

Article 13. Response to Violations

If a user violates these Terms, the Operator may take usage restrictions or other measures within a necessary and reasonable scope.

Article 14. Changes to These Terms

The Operator may change these Terms when it considers it necessary. Important changes will be announced in the App, on distribution pages, or by another method the Operator considers appropriate.

Article 15. Severability

If any provision or part of these Terms is held invalid or unenforceable under law, the remaining provisions continue in effect.

Article 16. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. Unless otherwise provided by law, disputes concerning the App or these Terms will be subject to the court having jurisdiction over the Operator's address as the court of first instance.
