Mono no Nedan

Mono no Nedan Terms of Use

These Terms of Use set out the conditions for use of the iOS app "Mono no Nedan" (the "App") provided by Foshan Gaoming Huiyang Network Technology Studio (the "Operator"). By using the App, users are deemed to have agreed to these Terms.

Article 1. Scope

  1. These Terms apply to all relationships between the Operator and users concerning use of the App.
  2. Explanations, notices, guides, and similar information posted in the App or on related pages form part of these Terms.

Article 2. App Content

  1. The App is used to record and manage information about items owned by users and to use daily cost, list display, graph display, comparison display, and related features.
  2. The App currently includes item registration, category and tag management, daily cost calculation, status management, dashboard display, list display, detail display, iCloud sync, lock by Face ID and similar authentication, display settings, and other features provided by the Operator.
  3. Specific features, names, screens, designs, and scope of the App may be added, changed, or removed at the Operator's discretion.

Article 3. Fees and Purchases

  1. The App provides basic features free of charge.
  2. The App offers auto-renewable subscriptions for some features.
  3. The subscription name, content, period, price, and other conditions follow the purchase screen in the App and the App Store display.
  4. Fees are charged to the user's Apple Account when the purchase is confirmed.
  5. Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Renewal fees are charged within 24 hours before the end of that period.
  6. Users can manage or cancel subscriptions at any time from device Settings > Apple Account > Subscriptions after purchase.
  7. If a free trial is provided, any unused portion of the trial is forfeited when a subscription is purchased.
  8. Paid fees are generally non-refundable except as required by law or Apple's rules. Refund procedures follow Apple's rules.

Article 4. User Environment

  1. Users are responsible, at their own cost, for preparing the iPhone device, network environment, power, Apple Account, iCloud environment, and other conditions necessary to use the App.
  2. Because iCloud sync depends on Apple services, it may not work normally due to user settings, network conditions, Apple specification changes, failures, or similar causes.
  3. If a user is a minor, the user must obtain consent from a legal representative or other necessary person to the extent required for use of the App.

Article 5. User Data

  1. Data entered, saved, edited, or deleted by users in the App is managed at the user's own responsibility.
  2. Users warrant that they have lawful rights to information registered in the App and do not infringe third-party rights.
  3. Users are responsible for confirming, organizing, and deleting data as needed.

Article 6. Intellectual Property

  1. Copyrights, trademarks, and all other intellectual property rights related to the App belong to the Operator or rightful third-party owners.
  2. Users must not copy, modify, adapt, redistribute, publicly transmit, sell, or perform similar acts regarding all or part of the App except where permitted by law.

Article 7. Prohibited Conduct

  1. Acts that violate laws or public order and morals
  2. Criminal acts or related acts
  3. Acts that infringe intellectual property rights, privacy rights, reputation, or other rights or interests of the Operator or third parties
  4. Acts that interfere with or may interfere with App operation
  5. Acts that place excessive load on the App or related systems
  6. Unauthorized access to the App or attempts to do so
  7. Reverse engineering, decompiling, disassembling, or otherwise attempting to analyze the App
  8. Registering false or inaccurate information
  9. Registering or using third-party photos, works, or rights-protected materials without authority
  10. Using the App for fraudulent or inappropriate purposes
  11. Any other act the Operator considers inappropriate

Article 8. Changes, Suspension, and Termination

  1. The Operator may change all or part of the App without prior notice to users.
  2. The Operator may suspend or stop all or part of the App for maintenance, failure response, communication failure, natural disaster, legal compliance, or other unavoidable reasons.
  3. The Operator may end provision of the App by announcing it through an appropriate method.

Article 9. Disclaimer

  1. The Operator does not guarantee that the App fits a user's specific purpose, has expected functionality, accuracy, usefulness, continuity, completeness, or safety, or is free from defects.
  2. Except in cases of intentional misconduct or gross negligence by the Operator, the Operator is not liable for disadvantages caused by user device environments, OS versions, Apple specification changes, App Store specification changes, iCloud or CloudKit specification changes or failures, network environments, or other circumstances outside the Operator's control.
  3. Except in cases of intentional misconduct or gross negligence by the Operator, the Operator is not liable for loss, corruption, sync failure, display inconsistency, or other defects involving user data.
  4. Users use the App at their own judgment and responsibility.
  5. If all or part of this article is invalid under mandatory laws such as consumer contract laws, the Operator's liability is limited to the extent permitted by those laws.

Article 10. Damages

Even if the Operator is liable for damages to a user, except in cases of intentional misconduct or gross negligence by the Operator, liability is limited to ordinary and direct damages actually incurred by the user.

Article 11. Personal Information

The Operator handles user information in accordance with the separately established Privacy Policy.

Article 12. Response to Violations

If a user violates these Terms, the Operator may take usage restrictions or other measures within a necessary and reasonable scope.

Article 13. Changes to These Terms

The Operator may change these Terms when it considers it necessary. Important changes will be announced in the App, on distribution pages, or by another method the Operator considers appropriate.

Article 14. Severability

If any provision or part of these Terms is held invalid or unenforceable under law, the remaining provisions continue in effect.

Article 15. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. Unless otherwise provided by law, disputes concerning the App or these Terms will be subject to the court having jurisdiction over the Operator's address as the court of first instance.
